WHAT DATA DO WE COLLECT? Clothy processes the data necessary to offer you the digital wardrobe and fashion assistant service: A) Data you provide directly: - Identification: Username, email, date of birth, and gender. - Physical Data (Required for AI): Height and weight. This data is used exclusively to adjust size recommendations and image generation. - Multimedia Content: Photos of your clothes and full-body personal photos uploaded to use the "Virtual Try-On" feature. B) Data obtained automatically: - Usage Data: Log of features used ('feature_usage' table) to improve the app. - Technical Data: Device information, IP, and unique identifiers for session management. - Payment Data: If you subscribe, we manage transaction identifiers associated with Stripe (we do not store your full credit card details). 3. PURPOSE OF PROCESSING We process your data to: - Manage your user account and access to the app. - Provide the "Virtual Try-On" and "Outfit Assistant" services: This involves processing your photos using Artificial Intelligence algorithms. - Manage subscriptions and payments (Premium Plans). - Send notifications about service status or news (if you have given consent). 4. USE OF IMAGES AND ARTIFICIAL INTELLIGENCE By uploading images to Clothy (both clothing and personal), you declare that you are the owner or have the necessary rights. The user grants Clothy a non-exclusive, worldwide, and royalty-free license to use, process, modify, and reproduce these images solely for the purpose of: - Generating clothing simulations using AI. - Storing them in your virtual digital wardrobe. - Maintaining the technical operation of the application. Clothy reserves the right to delete any image hosted on our servers for reasons of space maintenance, storage costs, or if we detect inappropriate content, without right to compensation. Images processed by AI may be automatically deleted after a reasonable time to ensure privacy. 5. RECIPIENTS (DATA SHARING) To provide the service, we share strictly necessary data with trusted technology providers (Data Processors): - Google Cloud / Vertex AI (Gemini): For AI image processing and analysis. - Stripe Inc.: For secure payment processing. - Hosting and database providers. We do not share data with third parties for commercial purposes without your express consent. 6. DATA RETENTION We will keep your data while your account is active. If you request account deletion, we will block the data for the legally required time (for tax obligations), and subsequently, it will be permanently deleted from our databases and image servers. 7. YOUR RIGHTS You can exercise your rights of Access, Rectification, Erasure ("Right to be forgotten"), Restriction, Portability, and Objection by sending an email to admin@clothy.es, attaching a copy of your ID to verify your identity. 8. SECURITY Clothy uses secure protocols (HTTPS/SSL) and password encryption to protect your information. However, no system is 100% impenetrable, and the user must diligently safeguard their password.
